Metal Trader’s Negligence Lawsuit Gets Thrown Out

A High Court judge has dismissed a $1.17 million negligence lawsuit brought by a metal trader against a warehouse operator and a Subordinate Courts bailiff. South East Enterprises accused warehouse operator Hean Nerng Holdings and Subordinate Courts bailiff Sapuan Sanadi of being negligent because they failed to give adequate notice of the seizure and sale of its machinery in the enforcement of a default judgment against the company. Daniel Koh of Eldan Law LLP, Hearn Nerng’s lawyer, argued that the bailiff is not an agent of Hern Nerng, unless it intervenes and gives special instructions to the bailiff. High Court Judge Justice Steven Chong agreed.
